Beginning February 1, 2009, CBP will begin it enforced compliance based on the published AES Guidelines. ITN

Consolidators has been in compliance with your help for some time, However, would like to take this time to

reiterate our needs from clients to ensure the timely movement of cargo.

ITN must have ITN numbers (the number assigned by Customs when a filed AES has been accepted and

approved by Customs), prior to established cutoffs.

If you do not file your AES and want us to file it for you, we need you to fill out, sign and send to us an authorization to file on your behalf. You can find this form on our website at: www.itnmiami.com.

For ease of filing, please provide the Customs ?B? commodity number for the products being exported. Also, please make sure that the exporting/commercial invoice properly describes the goods. Please do not use onlyproducts codes or proprietary names.

Just a reminder that if your goods are being shipped as an ?Export Routed Transaction?, we will still need your
company?s EIN number (IRS number) in order to file the AES.

It is very important that we all work together. Customs has published its guidelines for issuing penalties and
clarified a list of violations regarding AES filing. These violations include:

  • Failing to file export information in AES
  • Late filing of export information in AES
  • Failing to file all the required information in AES, filing incorrect information in AES, (incorrect value for the shipment, incorrect commodity description, failure to cite license code or number, etc.) or failing to comply with some other requirements of the FTR
  • Failure of the exporting carrier to provide certain documents or information to CBP

We will do our best to not load cargo that is not AES compliant. However, any fines or penalties and related
charges (demurrage, reschedule fees, late AES fee etc.) received by us as a result of late and/or incorrect
documentation will be passed on to the respective filing/responsible party.

We appreciate your cooperation and support on this issue.
